3. License Agreement
SOL SOLUTION hereby grants you a non-transferable license agreement for use of the identified Software in accordance with the terms of this Agreement.
3.a) Purpose of the agreement :
This agreement is a user license that grants the user the right to use the software and related documentation for their personal needs only, and for a limited period.
3.b) Intellectual Property :
The software and its documentation constitute original works protected by the law of 11 March, 1957 relating to literary and artistic property, amended by the law of July 3, 1985.
Therefore, the user expressly agrees :
- not to reproduce the software or its documentation.
- not to modify or integrate it into another software programme.
3.c) Warranty :
SOL SOLUTION guarantees that, when used under the proper conditions, the software is substantially capable of performing the operations described in the manual and the documentation relating to the software.
SOL SOLUTION cannot guarantee that the software will meet the user’s particular needs. The user is solely responsible for determining whether the software’s features are capable of satisfying their particular needs. Subject to the legal warranty that may cover the user, SOL SOLUTION accepts no liability pertaining to use of the software and, more generally, to any consequential damage or commercial loss that could arise from this use. In any case, even if it were established, SOL SOLUTION's liability in relation to use of the software is expressly limited to twice the price of this copy of the software.
3.d) Miscellaneous provisions :
The user is not entitled to transfer the rights and obligations arising from this agreement, which is governed by the provisions of French law.
